Abstract
Another factor that keeps government officials and institutions within the boundaries of the Constitution is the concept of judicial review. It is the principle mechanism for resolving disputes over federalism. Jack Rakove calls the idea that judicial review was created by John Marshall in Marbury v. Madison a myth. It was part of the original understanding, Rakove contends. What is not clear at the beginning is how judges will apply that power.
