Abstract
In 1966 Ernesto Miranda appealed a rape conviction to the Supreme Court and became the center of a landmark decision. His conviction was overturned on the basis that he had signed a confession without knowing he had the right to remain silent or have an attorney present during questioning. No matter how serious the crime, in the United States a defendant is innocent until proven guilty, and the crime he or she is charged with must be defined as a crime before the act. That is the rule of law.
