Abstract
Article III of the U. S. Constitution provides that there shall be one Supreme Court and such inferior courts as Congress should permit. It was the Judiciary Act of 1789 and subsequent legislation that created the system of federal courts that exist today. Constitutional scholar Jonathan Varat notes that "the system is designed to have a fluctuation of powers from time to time." As evidence he points to the era of the imperial presidency, the growth of the administrative state, and mid-20th century court decisions that transformed race relations.
